Terms for store members.

1. Who these terms apply to

These store terms apply to any business, and to any individual acting for a business, that creates a DiscoverTCG store profile, lists stock, or takes part in testing before public launch.

They add to our terms of use, which continue to apply in full. Where the two conflict on a matter specific to store members, these store terms take precedence. In these terms, “we” and “us” mean Stockulate, and “you” means the business.

2. Eligibility and authority

By creating or managing a store profile you confirm that:

• You are at least 18 years old.
• You are authorised to enter into these terms for the business named on the profile.
• The business is a genuine trading operation, not a placeholder or a competitor’s name.
• You hold whatever registrations, permissions and insurance your business legally requires.

3. Verification

We may ask for evidence that a store is genuine, and that you are entitled to represent it, and we may decline or withdraw a profile where we are not satisfied.

Verification is a check on authenticity. It is not an endorsement of a business, its stock or its pricing, and we do not present it as one.

4. Your store profile

You are responsible for the accuracy of everything on your profile, and for keeping it current:

• Trading name, address, contact details and opening hours.
• The products you list, and their prices and quantities.
• Any logo, photography or description you upload.

Out-of-date information is the fastest way to waste a collector’s journey and lose their trust, so we may hide or remove a profile that appears abandoned or persistently inaccurate.

5. Listings, prices and availability

• Prices should be shown inclusive of VAT where applicable, and should match what a customer would pay in store.
• You remain responsible for complying with pricing and consumer protection law in how you display and honour prices.
• You decide whether to sell, to whom, and on what terms, subject to your own legal obligations.
• You are not obliged to hold or reserve stock because it appears on DiscoverTCG.

6. No payments through DiscoverTCG

DiscoverTCG does not process payments for your sales, take orders, hold funds, or act as an agent for any sale. Transactions between you and a collector happen in your store, under your own terms, and we take no commission on them.

This is separate from the subscription described in section 10, which is a payment from you to us for store features and is the only money that moves through DiscoverTCG.

If we ever process payments for your sales, we will publish updated terms and tell store members before any such feature goes live.

7. Community findings about your store

Collectors can post findings that name your store. You do not control those findings, and we do not remove them simply because a business would prefer they were not there — their independence is what makes them worth reading.

We will act on findings that are false, manipulated, abusive or infringing. Report them through our reporting page and we will assess them under our community guidelines.

8. Your content and brand

You keep ownership of your logo, photography, descriptions and listings. You give Stockulate a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and adapt that material for technical formatting, so that we can operate and promote DiscoverTCG and your presence on it.

The licence ends when you remove the content or your profile, apart from reasonable backup periods and records we are required to keep.

9. Early testing

Store tooling is in development. If you take part before public launch:

• Features may change, break or be withdrawn, and there is no service level commitment.
• Data created during testing may be reset, and should not be your only record of anything.
• We may ask for feedback. If you give it, we may use it to improve DiscoverTCG without owing you payment or attribution.
• Please do not publicly share unreleased features or screens we have asked you to keep confidential.

10. Fees

Being listed is free. Your place on the map, your shop page at discovertcg.com, your address, opening hours and contact details are not charged for. They do not switch off, degrade or drop down the page if you never pay us anything.

The Store Profile is a paid subscription. Its price is published in full at discovertcg.com/pricing. At the effective date of these terms it is £34.99 per shop per month excluding VAT, reduced per shop where you run more than one branch. What it includes, and what is still being built, is set out on that page.

Who bills you. Payment is taken by Stripe, who act as merchant of record for the subscription. VAT is calculated, charged and accounted for by Stripe at the rate that applies to you, and your VAT invoice is issued through them. Every invoice can be viewed and downloaded from the billing page in your store console.

Month to month. There is no minimum term and no contract to exit. The subscription renews automatically until you cancel it, and you can cancel yourself at any time from your billing page. Cancelling stops the next payment; the paid features stay on until the month you have already paid for has run out.

If a payment fails. The paid features stay switched on for seven days while you sort it out. That grace is available once in any twelve-month period. If a payment fails again within twelve months of the last grace, the paid features end at that point rather than after a further week. Twelve months after your last grace, it is available again.

If the subscription ends, by cancellation or by non-payment, your shop returns to the free listing. Paid features stop. Stock beyond the free allowance published on the pricing page is hidden from public view. It is not deleted, and it returns if you subscribe again.

Nothing free becomes chargeable without notice. You will not be charged automatically for a feature that was free when you joined, and we will not move a feature behind the subscription, or change the price, without telling you first, giving you reasonable notice, and giving you the chance to decline. Where a paid feature is currently reaching shops on the free listing, that is a transitional state and this paragraph is what governs it.

11. Your own legal obligations

Your relationship with your customers remains yours. You are responsible for consumer rights, refunds and returns, product safety and authenticity, any age restrictions that apply to what you sell, your tax position, and your own privacy obligations to your customers.

You must not use DiscoverTCG to list counterfeit, proxy or knowingly misdescribed product. Doing so will result in removal.

12. Data protection

Each of us is an independent controller for the personal information we decide about. We are the controller for DiscoverTCG accounts and community content, as described in our privacy notice. You are the controller for your own customer records.

Information you place on a public store profile — your trading address, contact details and opening hours — is published to DiscoverTCG users by design.

13. Suspension and removal

We may hide, suspend or remove a store profile where:

• The business, or your authority to represent it, cannot be verified.
• Listings are persistently inaccurate, or the profile appears abandoned.
• Counterfeit or misdescribed product is listed.
• These terms, our terms of use or our community guidelines are breached.
• We are required to by law, or someone may be at risk.

Where it is appropriate and lawful, we will tell you why and give you a chance to put it right. You can appeal as described on our reporting page.

14. Responsibility

DiscoverTCG is provided as it is. We do not promise a particular level of visibility, footfall, enquiries or sales, and we are not responsible for a customer’s conduct, or for a journey a customer makes on the strength of a listing or a finding.

Nothing in these terms limits liability that cannot lawfully be limited. Subject to that, neither party is liable to the other for loss of profit, revenue or goodwill arising from participation.

15. Ending participation

You can stop at any time by asking us to remove your profile. We may end a store’s participation on reasonable notice, or immediately where section 13 applies.

Removal takes your profile and listings out of DiscoverTCG. Community findings that reference your store may remain, subject to our community guidelines.

16. Governing law and contact

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
